Injustice to Sanjay Dut

Court yesterday announced punishment for Mr. Sanjay Dutt and he has been sent to jail for six years on the charges of keeping arms in his home in violation of arms act.Blast occurred in 1993 and more than 15 years have passed. Now after prolonged hearing and evidences it has been concluded that he is guilt. This long period of 15 years is far more torturous than even jail for six years. It is not therefore justice delivered by the respected court but I will say it is injustice delivered.Firstly if criminal is allowed to move freely for 15 years he can damage the evidences, witnesses and can even cause much bigger damages if he so likes in revenge of likely punishment. On the contrary if the accused person proved to be innocent and it is found that for last 15 years he has been unnecessarily facing mental agony and physical difficulties in attending courts and bearing with loss of dignity in the society, the repercussions are more harmful for civilized society. As a matter of fact it is never criminals who are unhappy with delay in court proceedings and pronouncement of judgment but only gentleman, innocent and simple persons who are unhappy and who have to suffer a lot due to such inordinate delay.Actual Criminals and his henchmen manage the delay by dint of his money and muscle power as also high profile pressure and lead a peaceful life. He is not at all afraid of any punishment. Had he been afraid of punishment he could not have opted for wrong path of crime. It is therefore always the innocent person wrongfully or intentionally implicated in the civil or criminal cases gets punished and it is his image which is tarnished without any valid reason due to abnormal delay in court process of delivery of judgment. Courts are meant for providing security and mental peace to common man and punish those who disturb the social peace. But unfortunately what is happening is fully opposite to what is expected from the courts.In case of Mr. Sanjay Dutt I can say very correctly that he has already been punished of mental torture for last 15 years and now sending him jail for further 6 years is fully unjustified. People are praying for mercy for Mr. Sanjay Dutt and acquittal of charges framed against him .More than 80 percent of population who know his case will vote for his acquittal .I would like rather suggest that court should not only pardon him but should compensate him for such abnormally huge delay .Mr. Sanjay Dutta reportedly kept arms in violation of rules. It is true but such a severe punishment for the same and for such a small act is not at all desirable particularly when he is repeatedly praying for excuse. His intention was not at all bad. He belongs to a reputed family and his father remained MP in Parliament for considerably long period. He has changed himself, kept himself aloof from unknown person, and his work has been appreciated by many persons including our beloved Prime Minister Mr. Man Mohan Singh for his role in films and for Gandhigiri his film generated for general mass. His social image is good and he is highly reputed. There is no criminal record in his past life. Actual transformation in life and purification of heart which courts are supposed to aim for a criminal has already taken place in his life.On the contrary there are many hard core criminals with hundreds of criminal cases against them are sitting in the Parliament and State Assemblies. Criminals are occupying the top post in many departments or I can say that many top officers are indulged in more heinous and condemnable corrupt practices. Who is bothered of punishing them?Mr. Sanjay Dutt is absolutely a good person and he has got sympathy from majority of Indian population and people living abroad. Common perception about Mr. Sanjay Dutt is very good and gives no scope of any doubt on his integrity. For God sake he must be released from jail and acquitted of charges. Mr. Narsimha Rao, the Ex-prime Minister of the country when punished by learned court, was not sent to common jail but provided a special guest house for the same. Mr. Sanjay Dutt also deserves the same.Last but not the least that our central Government in Delhi has not yet decided on the mercy petition of Mr. Afzal Guru who has been sentenced to death by learned Supreme Court. Why is there delay in hanging of such hard core criminal?Whose master mind is behind delay in hanging of Mr. Afzal Guru?Whether such abnormal delay is justified?Why the opinion of our Home Ministry was not conveyed to President of India in time?Is Afzal Guru considered better than Sanjay Dutta.Danendra JainRanchi- 8340011st August 2007 e-shares.info
